Terms of Service

These Terms of Service (“Terms”) govern your use of the HomeHavn application and website (the “Service”) provided by HomeHavn (“HomeHavn,” “we,” “us,” or “our”), based in Ontario, Canada. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

HomeHavn is built for real estate professionals (“agents”) and the clients they invite. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement.

HomeHavn helps an agent give their client a personalized moving dashboard — a checklist of move-related tasks, deadlines, and links — and sends related reminders and updates. We may add, change, or remove features over time.

You are responsible for the information you provide and for activity under your account, and for keeping your login credentials secure. If you are an agent and you invite clients or enter information about them, you represent that you have the relationship with those clients and the authority and consent needed to provide their information to HomeHavn and to send them messages through the Service. As the agent, you remain your clients’ primary point of contact. Notify us promptly of any unauthorized use of your account.

If you connect your Google account, you authorize HomeHavn to send email on your behalf using your Gmail account, solely to deliver moving-related messages you initiate or authorize. We do not read, modify, or delete your mailbox. You can revoke this access at any time from your Google Account settings. Our use of Google data is described in our Privacy Policy.

You are responsible for ensuring that messages you send through the Service — including invitations and reminders to your clients — comply with applicable anti-spam laws, including Canada’s Anti-Spam Legislation (CASL). Only send messages to people you have a relationship with and who would expect to hear from you about their move. Do not use the Service to send spam or unsolicited bulk messages.

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose.
• Send spam or unsolicited messages through the Service.
• Enter information about a person without the authority or consent to do so.
• Attempt to gain unauthorized access to the Service or other users’ accounts.
• Interfere with or disrupt the integrity or performance of the Service.

Some features of the Service are offered under a paid subscription. Where fees apply, they are described at sign-up, and you agree to pay the fees for the plan you select. Unless stated otherwise, fees are non-refundable except as required by law.

The Service, including its content, design, and software, is owned by HomeHavn and protected by applicable laws. You may not copy, modify, or distribute any part of the Service without our permission.

HomeHavn helps organize moving tasks and surfaces deadlines and links for convenience. It does not provide legal, financial, tax, or other professional advice, and the deadlines and information it shows may not be complete or current for every situation. You and your clients are responsible for verifying any deadline or requirement with the relevant official source.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, HomeHavn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service.

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and close your account at any time.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws principles.
